Legal Question in Wills and Trusts in Connecticut

spousal benifits & wills

In June of 2003 I married a man who was divorced in 1998. He has to sons from that marraige. In 2001 he made a will leaving everything to his ex-wife for the children. My question is does our marriage change any of that in anyway. I am conserned about losing my home (he bought it befor our marraige) and any claimsI may have as a serviving spouse. Thank you, Mary Hundley

Re: spousal benifits & wills

In CT, unless a prior will contains language that the will remain in effect even if a divorse occurs, the prior will in not valid and the estate distribution would be as set forth in the statutes. If you have a copy of the will, an attorney would be able to tell you if the will survived the divorse. Tom Noonan
