Legal Question in Wills and Trusts in Connecticut

Trust Fund

When my mother passed away, eveything was left to my father except for a trust fund for myself and my two brothers. My father wants to dissolve the trust, under the guise of wanting to give us more money. He is not trustworthy and my opinion is he wants to give us nothing. He says that he needs to signatures to dissolve the trust. Can this be true?

Re: Trust Fund

The answer to your question is not clear without looking at the trust document. However, generally there are two types of trust, revocable and irrevocable. Revocable trusts can be dissolved by the settlor( the person who creates the trust). Irrevocable trusts cannot be dissolved by the person who created the trust.

Put simply, an attorney would have to look at the trust instrument to determine if your father (assuming he is the settlor) has the power to dissolve the trust.

Re: Trust Fund

Without seeing the trust agreement or the will that set up the trust, it is not possible to tell. Your father may have the ability to terminate the trust or may not.
