Like everything else, it really depends. Generally, the W Comp System does not require Claimants to retain lawyers. However, it requires that Claimants are willing to go through the trouble of being a "do-it-yourselfer," attending hearings, etc. (which an attorney can usually do without their clients being present). Also, if your claim is not straight forward, that is, if it requires you to make any choices at all, a lawyer will insure that you get as much out of the system as possible.

Whether or not retaining an attorney is a "waste of money" depends on whose interests are at stake. Insurance companies, like anyone else who is in business to make money, rarely give advice that is against their own best interest.

Whatever you decide, remember, you will be dealing with a W Comp. expert working for the insurance company.
