My husband and I agreed to allow my children to go to costa rica with him under the agreement that i would have equal custody when i changed my residency to costa rica from here in minnesota. I am now planning to move to costa rica and he is stating he will not let me stay with my children. I am a citizen of Costa Rica and he is not, i am curious what the laws on child custody are in Costa Rica and what I should do. Also i might add, that previous to the move, I had equal custody, but I had been charged with 4th degree assault. I did not loose custody but he was awarded a temporary order of protection from my children, however being that I signed the agreenment for him to take the children to costa rica, the order of protection was dropped. So all that I have on my record is a 4th degree assault. And also, my children living with him are a boy and girl, the girl is not his biological child, he did adopt her, but during our divorce he deniged he was her father in court in order to avoid paying child support, and I do have these records.
