Legal Question in Criminal Law in Delaware
Arrest
my sister and i got arrested for fighting a girl, but the girl attacked my sister 1st and the police wouldn't let her press charges on her is that legal if she has a witness too? My other question is are the police allowed to drop charges and the refile them? and are they allowed to do it without are knowledge?

cops can do that, but cases are reviewed by Attorney General who decides who is charged. We have been doing criminal defense since 1978, call us if you wish..........Good Luck!!
