confidental informants

if a judge rules that a confidental informants idenity is not to be disclosed and the supreme court reverse's the rulings of the court does the confidental informant remain anoymous

I am a Delawre criminal defense lawyer, have been for last 30 years, a prosecutor before that. I need to inspect the Supreme Courts' Order and ruling to give you definitive answer. Depending on the CIs' role in the transaction, his identity may be ordered disclosed. Usually the court will order a Flowers hearing (I convicted Flowers) and interview the CI in chambers out of jury presence. The judge then decides if need for disclosure outweighs States' ned to protect CIs' identity. Forward opinion, if you will. Ed Pankowski
