Legal Question in Criminal Law in Delaware

Theft Of Services

I left the dinner forgetting to pay. I walked out the front door with my little girl and waited to cross the four lane Hwy. My point is nobody tried to stop me. we didn't sneek out. I didn't act like I was going to the bathroom. I just forgot. Latter I found out the bill was for $13.00. The ploice officer told the dinner that I didn't have a record and that I seamed like a good guy and that I wanted to pay the bill. The dinner said no. And told the officer to press charges

The diner can't force the officer to press charges but they can try to get the matter approved as a private criminal complaint. Even then, the District Attorney may decline to approve it and they would then have to appeal to the Court of Common Pleas which is a whole lot of trouble over $13.00.

If you are charged you should get a local attorney to represent you. Even though it is a small amount, any theft charge is quite serious.
