Legal Question in Immigration Law in Delaware
i overstayed on my bussiness visa and then applied to have it converted to student visa...which was approved and then after taking a couple of courses in college i went back to india & now i am not being approved for student visa in india to return to usa....i am now applying for canadian visa...my question is if i get my canadian visa..can i get a visa to enter usa ona permenant or temporary basis...thanks

Canadian visa does not give you any more rights than if you did not have it. You'd still have to qualify for a US permanent or temporary visa on its own basis and requirements. You were probably denied the student visa at the US consulate in India because they could see you did not have a genuine intent to really be a student in the US. One thing a Canadian citizen could apply for that other countries cannot except Mexico is the NAFTA visa. But that has its own requirements that you'd have to meet. The point is, you can apply for any US visa that you feel you qualify for, and see what the decision is.
