Legal Question in Employment Law in Delaware

''Unpaid Wages''

In March, my employer filed for Chapter 7 in Delaware. I am a teacher and my school is a contract school with Harris County. We continued to operate under the trustees' supervision. We were also told salaries would be paid, in the summer, to those whose 10 months salaries were divided into 12 months. Now we are being told that we would not be paid those wages, which we have already worked for. How can I claim my unpaid wages and what chance do I have of recovering my loses?

Re: ''Unpaid Wages''

You need to file what is called a "proof of claim" with the bankruptcy court where the bankruptcy is pending. There is a deadline so move promptly. Your claim will have priority, but it may not be paid if there are not funds to do so. You may have additional rights and might wish to consult with an attorney to explore those.
