Legal Question in Medical Malpractice in Delaware

Allergic Reaction

My two year old daughter is allergic to penicillin. Seven months ago she had Stevens Johnson which was how we found out she was allergic. Her doctor had put on her chart, penicillin allergy, last week she was given a antibiotic with penicillin in it. I notified the doctor right after she took it, he said she would be fine. One hour later the hives started by 11:00 she was vomiting and covered in a rash. The doctor was notified and my daughter was put on prelone and benedrly. She was under watch for stevens johnson. She has recovered but does this constitute medical malpractice?

Sounds like it however unless there is some serious damage done it would not be cost effective to pursue it. Good luck.
