Legal Question in Real Estate Law in Delaware

He will not buy me out!!!

I bought a house with a man a couple of years ago. We are not married. I want to leave him but he does not want to separate. I asked him to buy me out and he said he would. I don't trust him so I asked him if I can see the paperwork where he applied for a loan at the bank and the receipt where he paid for an application fee. He doesn't have it. I know he is lying. He is trying to keep me there to pay for half of everything for as long as he can. I don't want to leave without my money but I don't want to stay there anymore. I need to go on with my life. Would it be considered abandonment if I leave the house? What can I do??!! I feel like a prisoner. Can I force him to sell? The house was appraised for $155,000 more than what we paid and I am only asking him for one third of that. I know he really wants to keep the house, he just doesn't want to give me the amount I want.

Re: He will not buy me out!!!

you. like him , are tenants in common each with 50% interest. You don't "abandon" the property by moving out, but your continuing equitable interest might stop if you stop contributing to mortgage, taxes, etc. Present him a sales contract to sell him your share, he may accept.
