Driving Without Insurance

Is conviction for driving without insurance a criminal or traffic offense in DE? What if you didnt know that the car's insurance had been cancelled?

Re: Driving Without Insurance

A first offense within 3 years for Driving without

insurance is punishable by a minimum fine of

$1,500.00 and a maximum fine of $2,000.00.

Furthermore, the persons driver's license will be

suspended for 6 months. If the car belonged to or

was leased by the person's employer and the employee

can show that they did not know and should not have

known that the vehicle was uninsured it is possible

to avoid a conviction. Otherwise, the person needs

to show that there was some insurance policy which

served to cover that person's operation of that vehicle.

It appears that Driving without Insurance is a traffic

offense in Delaware. However, moving violations are

misdeameanors.

Not knowing that the car's insurance had been

cancelled may lessen the fine under certain circumstances.

Without, knowing more about the circumstances of the

cancelling of the insurance, it is not possible to

be more specific.
