Legal Question in Wills and Trusts in Delaware

unpaid medical bills and Inheritance

My mother is on a ventilater and dying, her father died in sept. of this year and left my mother an Inheritance. My mother has about 65,000 dollars of unpaid medical bills. My mother has not yet received her Inheritance from her father because she has not signed the papers yet to release her share because she is in the hospital. My question is can the state or the creditors take her Inheritance money to pay off the unpaid medicals bills if she dies? I do know that if she passes away her Inheritance will get passed down to my sisters and I. Also my mother does not have a will. I do know how to protect her other assets from being taken from creditors but this Inheritance money that my mom has coming to her confuses me.

Re: unpaid medical bills and Inheritance

I suggest will for mom asap to protect her, and later, your assets. Our firms' will packet also contains living will and durable power of attorney. Mom needs to be lucid (understand what she is signing) we can bring documents to hospital or home. Cost will be $400-600 depending on travel. If you want to hire our firm, please send me an outline of will or we can fax you our office form. Ed Pankowski
