Sueing a company for neglect when it result in death

My husband fell through a hole in a roof 60 feet which resulted in his death, as a result of neglect, a piece of plywood missing to cover the hole. I was told by my lawyer that we cannot sue the company my husband was working for at the time, however we could sue the company that sub contracted my husbands company. Is this true?

If the accident happened in Delaware then, it is more

likely than not, that your attorney is right. Without

knowing more facts I cannot provide a more

definitive answer. In that your are presently

represented by an attorney you should consult him

or her concering this matter and make them explain

it to you in more detail. If you are unhappy with

them or they do not wish to explain it in the detail

you desire you can always hire a different lawyer.
