Legal Question in Business Law in District of Columbia

trustee

is it legal for a trustee to give his client personal advice? Example: My husbands' trustee told him that it was too early to put our funds together, yet the trustee has never met me. This doesn't sound legal or professional to me.

Dear LawGuru User:

The Trustee is obligated to comply with the terms of the Trust document and the law. Are you a beneficiary of the Trust being handled by this Trustee?

I do not have the Trust document, and therefore lack sufficient information to give a definite answer.

I can only say from what you have told me that what the Trustee did in this case does not sound improper. It appears that the Trustee counseled your husband to pursue a safe course of action vis a vis his assets.

There are occasions when a beneficiary needs to hire an attorney to explain or even enforce a Trust document. I posted on that subject on LawGuru in the past and the information should be still available on this site should you wish to read it.

Thank you for using LawGuru.

Sincerely,
