If a computer repair firm, which compensated me instead of fixing my

computer, sold that computer with my

data on it without giving my an option

to erase the data myself, would I have

legal recourse?

By compensating you, I assume that you received money

from the repair shop in return for your not receiving your repaired computer back.

If so, as to the repair shop's disposing of the unit without giving you an opportunity to erase the data, my only question would be: how were you provably damaged by this oversight?

If you have no credible answer then you would have no legal recourse (in my opinion).
