Re: where should i file? what should i do?

Each of you is responsible for the "whole enchilada", so to speak,(meaning, of course, the amounts due under the lease). The law calls it "jointly and severally liable", and the creditor is allowed to pursue each or both in order to collect the full amount that is due.

If you're the only one available with attachable assets, then you may end up paying the whole amount. If such occurs, you will then have the right to sue your former co-tenant for his or her share of the delinquent debt which you ended up paying.
