Legal Question in Credit and Debt Law in District of Columbia
Private Loan has not been paid
I have lended my friend some money to help pay for the rent. She was supposed to make payments and never did. At this point she has moved to GA from NJ and I am not sure what here address is. All my attempts to contact her has failed and I need to file a lawsuit agains her, but I don't have an address where she stays now (with her grandma). I do have her parents address and phone#. Please advise me since this is the first time I have been in this situation.

You must get personal service over the person you are suing. You really need to be able to find the person before you file suit. Use the internet as much as you can, and if that fails, you may have to pay someone to track this person down. You can also do this after filing suit. When you file the suit, tell the clerk you want to serve the defendant via personal serive. The court will then mail you the writ of summons to be served. While the court is preparing that for you, you can be tracking down your defendant. If you do not find them by the time the writ of summons expires, you can have the writ of summons renewed by the clerk.
