How can you charge somebody with second degree murder and there's no evidence saying the defendent did it and he did't get charge for the weapon.

If this somebody was charged with a serious crime such as second degree murder, you can be assured that there was sufficient evidence to form what's called probable cause(the legal basis) for the arrest, even if you yourself apparently, don't know what is and/or simply don't understand it.
