Legal Question in Criminal Law in District of Columbia

gift card fraud

I brought a store gift card from a stranger, made a purchase and then tried to change the purcahse and it was denied by store w/o explanation. I tried to contact seller to no avail. Some months later im contacted by fbi that i used a fraudulent gift card (from a person under investigation) and i need to be questioned/be a witness. Will i be charged? can i go to jail? What is the worst case scenario?

Re: gift card fraud

You could potentially be charged with a theft related crime, but if you had no knowledge that the card was fraudulent, you may not be convicted. I would be very careful about what you say to the police.

Re: gift card fraud

No, it's unlikely that you'll be charged or convicted of anything (but law enforcement may convince you that you need to be a witness in the matter).

Lesson learned: Beware of strangers bearing gift cards of uncertain origin for sale.
