Re-sale of concert / event tickets

Is it legal to re-sell concert and event tickets for more than face value in Washington DC, VA and MD? I am referring to private sale � individual to individual, not to a ticket brokerage.

As long as you're not engaged in so-called "scalping", I believe that it is.

Revised answer: The different jurisdictions appear to have different approaches to anti-scalping regulations.

In Maryland any sale or resale of tickets above the price printed on the ticket is apparently prohibited.

In D.C., any price exceeding one dollar above the price printed on the ticket along with a sevice charge more than $3 is apparently prohibited.

In Virginia, there is also anti-scalping regulation but it appears to be left up to the municipalities as to

what form it may take. Charitable and nonprofit events appear to be exempted from antiscalping regulation.
