Legal Question in Family Law in District of Columbia

Filing for Divorce

I live in Virginia and am recently separated. If I move to DC can I file for divorce after I meet the 6 month residency requirement and show I am separated through an agreement for 6 months. I was married for 13 years and have one child, 9 years old.

Re: Filing for Divorce

If you fulfill D.C.'s six month residency requirement and have been separated from your spouse due to a mutual agreement for a minimum of six months, then you should be able to obtain a divorce under D.C. law. You would be well advised, however, to consult with a lawyer, especially if you are planning to move to D.C. for the express purpose of obtaining a divorce.
