at what point is it illegal to record a phone conversation?

There are 38 states including the District of Columbia and Virginia which are classified as so-called one party jurisdictions, which require the knowledge and consent of only one of the parties to the telephone conversation in order to record it at any time without the knowledge or consent of any other parties on the line.

The remaining 12, including the state of Maryland, are so-called two party (or all party) jurisdictions which require the consent of all parties on the line before any recording may commence.
