how does he file for joint custody if they live together?

Custody can be either legal, physical or both. Joint legal custody means both parents have a say in the upbringing of the child. Physical custody refers to the parent with whom the child actually resides. Joint physical custody means that the child resides with each parent for at least 35% of the time. Obviously if the parents are living together, they would already have de facto joint custody, but if one of them moves out and has been legally awarded sole physical custody, he/she would take the child with them.
