Marital Separation

My husband and I are

recently separated. We

have been married for 15

years. We lived in CA for

3 years until my son and

I moved to Washington

DC in February 2009. I

am unemployed and need

to make sure my son and

I are taken care of

financially. I would like

to file for a legal

separation, but am

getting conflicting advice

on where to get a lawyer;

CA or DC. Please advise

on what I should do.

If your husband remains in California with the accumulated marital assets, that's where you should retain counsel in order to negotiate a property settlement agreement designed to settle most (if not all)of the major issues in your marriage.

Any action that you initiated in DC would be unlikely to establish personal jurisdiction over your husband in California that would allow the court to rule on financial and property issues associated with the marriage.
