Legal Question in Family Law in District of Columbia

Non biological child - support?

My fiancee has been separated for 9 years. His ex's child is now 10.( He was 11 months when they separated). He is not the biological father. She will not sign a divorce judgment unless my fiancee begins to pay support for him. How long can she hold this up?

Re: Non biological child - support?

If your fiance and his wife have been separated for nine years, he can file for divorce on his own--now. She the wife will never have to "sign a decree of divorce."

His wife may ask that the court award child support when he files for divorce. If he is not the father of the child, he should see an attorney and get a blood or DNA test. Contested paternity cases are serious, and your fiance may end up paying child support for a long time---even if he is not the biological father.
