Legal Question in Medical Leave in District of Columbia

Currerntly, I am on FMLA Leave due

to severe anxiety and depression

caused by the supervisor at the workplace. I am under the care of

my primary physician as well as a

trained psychologist. Both feel that

I am not physically or mentally able

to go back to work. I understand that if I do not let me employer know whether or not I am going to

return at the end of October, I will

officially be terminated from my

position. What advice can you give

as far as if one is fired for medical/

psychological cause which is supported and I don't return to

my job, can any legal action be

taken against the employer since

they are aware of the current

situation and are responsible in

a sense for allowing one of their

supervisor to harass, bully, demean

and allow an abusive work situation. Why doesn't the law

protect one from such harassment

even though it is not in the protective class that EEOC defines?

I don't have an answer for this question, but, perhaps, your state representative or congressperson might have some ideas on this particular issue.
