Legal Question in Medical Leave in District of Columbia

Applied 4 FMLA for a caregiver to my parent w/chronic med cond/ MD certification given/I desire intermittent work sched/It will only be granted if my boss agrees. Is this legal?

SECTION 102(b)(1)of the FMLA also states that (subject to certain conditions)leave "may be taken intermittently or on a reduced leave schedule when
medically necessary". The implication here (as I read it) is whether or not the employee and his or her employer can agree on it.
