Legal Question in Civil Litigation in District of Columbia

Should I pay ticket?

I was a pedestrian not in crosswalk, hit by motorcycle. I was given $5 ticket. To pay ticket is to admit liability. What about civil liability, if the motocyclist sues me. Should I pay this ticket?

Re: Should I pay ticket?

If the motorist were to sue you for damages occasioned by the accident, you would assert the defense of contributory negligence which is still recognized in the jurisdiction of the District of Columbia as an absolute bar to any plaintiff's recovery of damages. (The foregoing, of course, assumes that even if you were not in the pedestrian crosswalk, that the motorcyclist was still, nonetheless, very likely in some measure responsible for allowing his machine to strike you.)

Paying the ticket should have no consequences with respect to this matter.
