Asylee status

Good afternoon,

My j1 visa expired in February, currently I'm on 30 day voluntary departure period, pending results of my aslylum interview. I'll have fallen out of status by the time such decision is made.

Will the period of waiting for the decision on asylum interview be considered an oversaty and negatively affect my ability to obtain US visa in future?

Is a person whose asylum claim was referred to immigration court considered to have violated a US immigration law (assuming voluntary departure has been granted)?

I don't think it will but you might want to check with the office of the Bureau of Customs and Immigration Services (BCIS)which handles your local area.

Regarding your question as to whether the fact that a person's asylum claim has been referred to an immigration court would in and of itself indicate that that person was necessarily in violation of U.S. immigration laws, the answer is most assuredly, no.
