Legal Question in Immigration Law in District of Columbia

How Early Can I Renew My Visa

I work in Washington DC as a house-maid for an ambassador. My work visa expires in April 2004. I am going to my home country for vacation this month, November 2003.

Once in my home country, how early can I apply for my visa, so that I can return here? Or if I am returning in early January 2004, can use the same visa (the one that expires in April 2004) for returning? Since the visa will still have a few months?

By the way how early (before the given expiration date)can people renew their US visas?

Re: How Early Can I Renew My Visa

Your questions should be directed to the organization or person(the ambassador)which or who originally sponsored your application for a

temporary work visa or you could also contact the

local Bureau of Citizenship and Immigration Services agency which serves the area in which reside.

You should be able to use the visa which you currently have and which expires in April 2004

to make a relatively short visa to your home country and to return to the U.S. without the

need for obtaining a new one.

Re: How Early Can I Renew My Visa

I would have to see what kind of visa you are on. Generally speaking, you can reenter on your old visa and be admitted beyond the expiration of the visa as long as your passport is valid.

How early you can apply also depends on visa and consular practice. If you are filing for adjustment of status/ renewal while in the U.S. usually you are allowed to file 120 days before your visa expires.
