Legal Question in Immigration Law in District of Columbia

LCA for h1b

hi

am on h1b, my employer is based in CA...and we have LCA file in CA..

now that i am placed on a contracting position in IL...

do we need another LCA to be filed in IL....

is it a rule or what does the h1b law says?

Your employer is responsible for maintaining and

updating all documentation required to support the

four statements of attestation on the Labor Conditions Application/Form ETA 9035E (including any notices regarding changed conditions from those reported on the original LCA).

This documentation is to be maintained at the employer's principal place of business along with a copy of the original certified LCA and available for public inspection. As to whether your employer may need to submit a new LCA for the changed circumstances which you've described, you could direct your inquiry to Department of Labor, ETA Application Processing Ctr., P.O. Box 13640, Philadelphia, PA. 19101. (In my opinion, there is probably no need for a new LCA as long as the supporting documentation has been updated to reflect the change in employment venue.)
