Legal Question in Employment Law in District of Columbia

I got caught stealing from an employer, overtime amounted to $4000. They are not pressing charges and want me to sign a paper that I will pay the money back. I know I'm LUCKY to not be arrested. But my last check which was 91 hours was not given to me, and I worked last week which would be an additional $500. Now I understand what I did was wrong but as I'm learning about this. I've been working anywhere from 90-105 hours per pay period and I've NEVER been paid over time. Should I file a claim, or ask them to apply what they owe me in over time to the money I took?

You do not indicate how long you were working or your salary, but if you were only earning minimum wage, you would have been entitled to a minimum of $400+ per week in extra compensation. In this instance, you were both stealing from each other and while you could face criminal charges, there are also extremely severe penalties for your former employer. This requires a delicate balance. Definitely contact an attorney.
