Legal Question in Employment Law in District of Columbia

Exempt Employee forced to take lunch?

I am an exempt employee and my contract is for 40hrs a week. I have now been told that I will be required to be scheduled for 45hrs per week and that I must take a one hour lunch break. Most days there is not time for lunch and if I have time it is a working lunch. Does the law in DC support forcing me to take this break or can I continue working my scheduled 40 hours without a lunch period?

Re: Exempt Employee forced to take lunch?

If the terms of your employment contract require only 40 hours on your part, then your employer cannot legally require you to work 45 hours without effecting a breach of the contract and giving you a possible basis to file a lawsuit.

As far as I know, DC labor and employment law have nothing to offer on this particular issue, i.e, your contract rather than DC employment statutes is likely where your focus should be for possible recourse.
