Federal Dismissal Policy

I am currently an employee with the US Department

of Commerce. Before that, I worked in the private

sector for a start-up company based locally.

During my time in the private sector the FBI

investigated activities related to our public sector

division of the start-up in which I was employed. The

matter went away but recently surfaced early this

week. To make a long story short, m attorney has

advised me to plea guilty to a misdemeanor charge,

larceny by trick of property belonging to the

government in an amount less than $1000, in violation

of 18 U.S.C. s. 641.

My lawyer has also advised me that I will lose my

position with Commerce as a result of the guilty plea,

as Justice will call Commerce to make sure I�m

terminated. Since my current attorney does not handle

employment issues, my question revolves around this

issue. Does Commerce/Justice have the right to fire

me over this issue, even though the action took place

during a previous employment period?

What's your attorney's authority for his assertion

that you'll be terminaterd from Commerce as a result of your pleading guilty to a misdemeanor charge?

Furthermore, is it truly clear that the prosecutor has evidence persuasive enough to

convict you of this charge---beyond reasonable doubt?
