Wages taken by emplyer....need legal advice

I am a server in a large corporate restaurant and this evening my employer took $75 of my wages without my consent... here is the situation....

I worked a banquet party approximately 6 months ago. All of our banquets are contracted out by our private banquet coordinator. With each banquet, the customer signs a contract which includes such information as the time frame of the event, the food that will be served, and the price of the function. Included in this contract is a section regarding grautity... a section that states that there is a 20% service charge included in all private dining events. The client must sign this contract before any function will take place.

The night of the banquet, the check totaled approximately $340... a subtotal of $260, service charge of $52 and $26 in tax. the check was presented to the guest and a credit card was given to pay the check. Upon collecting the check, I noticed that the guest had left an extra $75 in gratuity on the check. I thanked the hostess of the event and clarified with her that the grauity had been included on the check. She waved me off and I went to my manager to inform her of the events that had taken place.

If your employer received the 20% gratuity, it would seem unfair that they're also taking the extra $75 which appears to have been intended as an extra tip for your services.

You might want to bring the issue up with the HR or whoever it was that authorized that your wages be docked the $75 that apparently was intended as an additional gratuity for you for a job well done.
