counterclaim

I leased a so called commercial space.Gave deposit with security.I apply for a civil suit,now I am relocating and do not want to pursue the case.I have file a voluntary dismissal of the case and counterclaim,but his lawyer is not interested. I never did business in the space.Zoning administrator has issue a non conforming use ''extinguished'' What can i do before the initial conference.

You would have no authority to request the dismissal of the counterclaim. About the only thing you can do in preparation for what is presumably the the mediation conference is to have all of "your ducks in a row" with respect to your evidence and facts which support whatever position you are taking in the matter, particularly with regard to the non-conforming use issue which apparently may have precented you from even moving into this commercial space if you had wanted to. Make sure that you bring to the conference actual proof of this non-conforming use ruling by the zoning administrator.
