Earnest money deposit

I have a contract on a property/condo in DC. A few days before settlement, the listing agent sent an addendum to the contract for me to sign saying she is related to the seller. I refused to sign it because it was not disclosed to me the time we were negotiating the contract and before it was ratified. I was told that I cannot get my deposit back because of this and that the contract is not voidable because I got this disclosure before settlement (4 days) Further, the condo was recently converted -- a four unit building.. Apparently the owner or someone lived in the unit that I am buying as evidenced by the grease in the oven and the dirty jacuzzi tub and the refrigerator. I am buying it as a new home, not a resale so I am also disturbed by the fact that the unit has been used. Am I entitled to my deposit back??

Perhaps, but you may have to sue in DC Superior Court to get it.
