Landlord Tenant

I am a property owner with a leased property due to expire 8/3/08. The property is leased by 3 tenants, 2 of whom wish to renew the lease for another year. I am proposing that they sign a new lease by 7/03/08 in consideration for my forgoing my right to list and recruit new tenants during the 30 day notice period. How should this be done legally? Thanks

Send a letter and maintain proof of delivery. If you want, you can force the point by giving notice to vacate effective 7/3/08. Then start showing the property.

Simply add your proposal in as one of the provisions of the renewed lease agreement to be signed by the remaining two tenants.

This answer is based on California law. I see "DC" in the question header. If you meant to inform LawGuru that the rental property is in the District of Columbia, you should get an answer from an attorney who practices there.

What 30-day notice period? There is no notice period at the end of a lease for a definite term. It is usual and customary for landlord and tenant to confer about possible renewals, a walk-through inspection, etc., but neither the landlord nor the tenant is required to give any notice whatsoever. The lease simply ends, with or without notice.

The landlord has a right to enter the leased premises upon prior reasonable notice, presumptively 24 hours written notice, for certain purposes including showing it to prospective buyers, tenants, repair contractors, etc. You could agree to forgo some or all of these rights if they renew promptly. You'll need to make them an offer in writing so that they can see the terms of the proposed lease extension, especially what the new rent will be.
