Legal Question in Real Estate Law in District of Columbia

Legality of lessor selling property before end of lease

Is it legal for the owner of a rental property to sell the property

before the current lease expires? What recourse, if any, does the

renter have in this situation if they do not want to vacate the

property until the end of the lease and have had no lease violations?

Amendment to prior answer: The new owner's

mortgage is subject to your prior lease, i.e,

you have the right to remain in the property until the lease is up.

Yes, the owner may sell the property before your current lease expires. However, the owner must still comply with the notice of lease termination requirements before he can legally force you to vacate the premises.

If the owner fails to comply with these requirements and sells the property, your recourse

is to demand reimbursement for whatever reasonable

costs that you incur by having to relocate before the term of the lease was up----unless the new

owner agrees to accept the balance of the lease agreement and allows you to stay on until it expires.
