Legal Question in Real Estate Law in District of Columbia
Predatory lending invetigations
I was told about a possible investigation going on concerning Predatory lending in D.C. I believe my late Grandfather and my grandmother who suffers from Alzheimers were victims of this practice . My retired grandfather, who was a diagnosed scitsofrinic and was not of sound mind to take out a second mortgage on their property, ended up losing it . I wanted to know what could be done . Any advise would be greatly appreciated . Thank you

Re: Predatory lending invetigations
Your question relates to various possible issues dealing with fair lending practices. Relevant federal law would involve the Truth-in-Lending Act and Reg Z, perhaps the Real Estate Settlememt Procedurs Act (RESPA), and others. The issues will revolve around whether the lender complied with these laws and regulations (in addition to relevant state and local laws) and perhaps whether the mortgage(s) could be, or could have been, voided. Questions as to dates are of most relevance since there are applicable statutes of limitation. In short, more information is needed, but there may be some remedy available to you. I suggest that you contact an attorney who specializes in real estate law and residential lending practices.
