Tree Damage
Neighbor (plaintiff), attempts to sue next door neighbor (defendant) for damages from tree branches extending over other properties. Two thirds tree base situated on plaintiff's property, 1/3 tree base is situated on defendent's property. Who does the tree belong to. Who is resposible damages resulting from tree branches?

Tree might be shared property between plaintiff and defendant or it might belong entirely to the plaintiff. If the former, and the damages were foreseeable, they might be apportioned between plaintiff and defendant; if the latter, the responsiblity for the damages would likely be the plaintiff's alone.
However, it is very likely that much more information as well as additional relevant facts would be needed in order to correctly determine this matter.
