Brother to Jail for Selling Me the House at a Discount?
My brother is in charge of my parent's estate. I want to buy the house from the estate for less than market value. He tells me he can not sell it to me at a discount because that would be ''cheating the estate''. He said he would go to jail for selling it to me for less than market value. The other heirs don't care what happens and don't understand why he is playing hardball. My brother's name is second on the mansion's original deed as a ''joint tenant''. Is he lying about him going to jail if he sold me the house at a discount?

Re: Brother to Jail for Selling Me the House at a Discount?
Your brother is not lying about the possibility of his going to jail if he were to sell you the property at a discount and thereby in effect commit a larceny against the estate to which he owes a fiduciary duty as its executor or administrator.
