Sec. 19-113(e) of the D.C Code outlines the elective share of a surviving spouse or domestic partner as that which the surviving spouse or domestic partner would've received if the decedent had died without a will and which in no event is to exceed one half of a net estate passed by way of a will with real and/or personal property of the decedent.
