husbands unexpected death

my husband recently passed away.there was no will. he owns nothing. i do however need to obtain medical records. upon contacting the hospital they informed me that the only way to obtain medical records is to file as executor of his estate. is this true? how do i go about doing this with out paying too much?

You can go to the Probate Division on the Fifth Floor of the D.C. Superior Court and ask to complete papers to be appointed as the personal representative/administrator of your deceased husband's intestate estate. (Whatever fee that is involved should be very modest.)

I must say, however, that I find it puzzling as to why the hospital would refuse to release his medical records to you as the surviving spouse without filing for probate.
