Legal Question in Workers Comp in District of Columbia

commissiners decision

I was recently found total permanent by a commissioner. Now the insurance company is appealing it. When I go to court, will the commissioner's decision have a factor on the judge's decision. Will the judge hear what the commissioner had to say or will that be allowed to be brought up.

The commissioner's decision should be a factor

in whatever final ruling the court makes.

You would be well advised to have an attorney representing you in the court proceedings.

I'm assuming this was a decision by an Administrative Law Judge in DC; they're not called commissioners. In DC, a party wishing to appeal does so to the Dept. of Employment Services, and from there to the court of appeals. The appeal is on the record so the ALJ's decision is obvously known to the appeal tribunal.
