Legal Question in Workers Comp in District of Columbia

I hurt my back in December of 1999. I am now in the process of going for total permanent disabiltity.The doctor said I have a 37% impairment rating. Since I was hurt in 99, a new law went into effect i think around 1999, stating that you no longer get paid for the rest of your life, but rather a certain number of weeks. SO, would I get paid for the rest of my life or just an X amount of weeks? I am wondering if the law was passed before I hurt myself? IF not, would I be entitled to payment for the rest of my life if the judge grants total permanant disability.

Your case depends on many factors. Under permanent total disability you may be limiting your case. Compensation for your injury should be reviewed by an attorney.

Up to 250 weeks are available under a serious disability. There is no requirement for a settlement to be offered; however, in certain circumstances this may be beneficial. Payment of medical benefits is another matter.

Under the DC worker's compensation law, a back injury is not compensated by a specified number of weeks. There are two competing formulas, but essentially it is based upon a demonstration that the employee's earnings and earning capacity have been diminished by his injury. You definitely should seek the services of an attorney who handles these kind of cases before proceeding to a hearing.
