Legal Question in Workers Comp in District of Columbia

Which State to Draw Workers' Compensation

I was injured on the job in Washington D.c.. I was told by the insurance adjuster I would be better off going through the workers' compensation through the state of Maryland and had me sign a workers' compensation form, now I find out that I should have gone through Washington D.C.. Can I get this changed over to D.C. or is it legally binding.

Re: Which State to Draw Workers' Compensation

If the Md. comp commission hasn't done anything other than assign a claim number, you might be able to close the case and open one in DC. However, you need to understand that there are time limits you may run afoul of depending on how long ago the accident occurred. I suggest you contact the MD. comp commission and discuss it with them, or consult with an attorney who does a lot of work in the field of worker's compensation. You may find that there isn't much to be gained by doing what you are contemplating from the standpoint of the benefits to which you are entitled.
