illegal pregnant

hi

my brothers girlfriend is here on a visa. during her stay she became pregnant with my brothers baby. he wants to marry her before she goes back to santo domingo. how soon will she be able to return to the u.s.? will she be able to return before the baby is born which its due date is april 2006. her visa i believe is a work visa and expires at the end of september 2005. her parents want her back home and for him to marry her in santo domingo. i think this will make it harder for her to return into the states

In reference to your question: Option 1: You mentioned she had a working visa that expires Sept. 2005. Does her current employer want your brothers' girlfried to keep working for him? If yes, then he might be wiiling to help her renew her working visa. If no, ask her how did she obtain the working visa that she has now and tell her to try to renew it that way. Option 2, Ask her if she has a valid turist visa? and if she does,when does that one expires? If it expires later than April, 2006 then she can get married where ever she wants (I recommend the USA)and still fly back and forth to the USA and stay there 3 months at a time. However, I do recommend them to get married as soon as possible (assuming your brother is a USA Citizen) so they can, now as a married couple, start the USA naturalization procedure for her.

In regards to her giving birth in which country, I highly recommend her to give birth in the USA but only after she is married to your brother. The INS will give him less of a hassle if he does it that way.

Important note: When effecting visa renewal and everything related to immigration docs. please try to keep the pregnancy issue secret (That's if it is isn't too obvious).
