Legal Question in Bankruptcy in Florida
should a 64 yr old woman consider personal bankruptcy if she owes 25,000 in credit card debt and makes 26,000 per year. I would like to retire at age 66 and try to save a little money. Would my home have to be included in anything...........I have a 50k mortgage.

Hi. There are a number of factors you might look at. For example, how's your credit? If you have good credit and your credit is important to you, you might look at other ways to solve your problem. You might also contact a non profit credit counseling agency and see if they can help you negotiate better terms on the credit card balance so you can pay it off sooner. Bankruptcy is always an option, but you may have less drastic measures you can take to solve your problem.
If you do claim bankruptcy, and if you continue to pay your mortgage, then it will be excluded from the bankruptcy. However, your bankruptcy will not wipe out the mortgage.
If you are just paying interest/minimum payments on the credit cards, and the balance is not
getting smaller you should consider a "fresh start" Ch 7 bankruptcy. Your home and home mortgage will be disclosed, but should not be affected if you continue to pay your mortgage on time.
